PillarCopia Operating LLC, DBA ZU2B ("we," "us," or "our") owns and operates ZU2B Pulse at https://pulse.zu2b.com and other sites linking to these Terms of Use (the "Service"). These Terms of Use ("Terms") govern your access to and use of the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. We reserve the right to update these Terms at any time. Continued use after changes constitutes acceptance of the updated Terms. We will make reasonable efforts to notify you of material changes by email or by displaying a notice on the Service.

You must be at least 13 years of age to use the Service. If you are under 18, your parent or legal guardian must read and consent to these Terms before you use the Service. By permitting a minor to use the Service, the parent or guardian agrees to be responsible for the minor's activities.

By using the Service, you represent and warrant that you have the legal capacity to enter into a binding agreement. If you use the Service on behalf of a business or entity, you represent that you have authority to bind that business or entity.

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your password and account credentials.
• Notify us immediately of any unauthorized use of your account.
• Accept responsibility for all activities that occur under your account.
• Log out at the end of each session, especially on shared or public devices.

We reserve the right to disable or terminate accounts at any time in our sole discretion, including for violation of these Terms.

The Service offers both free and paid subscription plans. By selecting a paid plan, you agree to the following:

• Subscriptions are billed on a recurring monthly or annual basis through Stripe.
• You authorize us to charge your payment method on file at the start of each billing cycle.
• Subscription fees are non-refundable except as required by applicable law.
• You may cancel your subscription at any time through the billing portal. Cancellation takes effect at the end of the current billing period.
• We reserve the right to change pricing with 30 days notice. Continued use after the notice period constitutes acceptance of the new pricing.
• Certain offerings may be free of charge or offered for a fee, and we reserve the right to change what is offered free or for a fee.

You may cancel your ZU2B Pulse subscription at any time. Here is exactly what happens when you do:

• Cancellations take effect at the end of your current billing period. You retain full access to your plan features until that date — no service is cut off early.
• To cancel, log in to your account, open the billing portal, and select "Cancel subscription." You can also email us at [email protected] and we will process the cancellation for you.
• Monthly subscribers: cancellation stops the next monthly charge. Annual subscribers: cancellation stops the next annual renewal.
• Subscription fees already charged are non-refundable except as required by applicable law. Partial-period refunds are not issued.
• After your subscription ends, your account reverts to the free tier. Your scan history and saved reports remain accessible on the free tier for 30 days, after which paid-tier data may be removed.
• If you cancel during a free trial, no charge is made and your trial access ends immediately upon cancellation.

If you believe you were charged in error, contact us at [email protected] within 30 days of the charge and we will review your case promptly.

You agree to use the Service only for lawful purposes. The Service performs passive, read-only HTTP checks against publicly accessible URLs — including URLs you do not own — for legitimate purposes such as competitive analysis, benchmarking, and performance research. You may not:

• Submit URLs for the purpose of conducting unauthorized security testing, exploitation, or targeted attacks against any website or its infrastructure.
• Use the Service to scrape, harvest, or systematically extract data from third-party websites beyond the passive performance signals the Service is designed to measure.
• Attempt to reverse engineer, decompile, or disassemble any part of the Service.
• Use automated tools to access the Service in a manner that exceeds normal usage patterns or circumvents rate limits.
• Transmit any malicious code, viruses, or harmful data through the Service.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Post or transmit content that is defamatory, obscene, hateful, or otherwise objectionable.
• Use the Service in any way that violates applicable local, state, national, or international laws.

The Service may allow you to submit URLs and other information for analysis ("User Content"). You retain ownership of your User Content. By submitting User Content, you grant us a limited, non-exclusive license to process that content solely for the purpose of providing the Service to you.

Where you submit URLs you own or control, you represent that you have the right to do so. Where you submit publicly accessible third-party URLs for passive performance analysis (such as competitor benchmarking), you represent that your use is lawful and consistent with these Terms. You are solely responsible for the accuracy, legality, and appropriateness of all URLs and content you submit.

All content, features, and functionality of the Service — including but not limited to software, text, graphics, logos, and the ZU2B Pulse name — are the exclusive property of PillarCopia Operating LLC and are protected by applicable intellectual property laws.

ZU2B™, ZU2B Pulse™, and all associated logos, names, slogans, mottoes, origin stories, designs, graphics, software, platform content, and ZU2B Kids characters are trademarks, tradenames, copyrighted materials, and intellectual property of PillarCopia Operating LLC and may not be used, reproduced, distributed, modified, or displayed without prior written permission.

Scan results generated by the Service are provided for informational purposes only. We make no guarantees regarding the accuracy, completeness, or fitness for a particular purpose of any analysis results.

Performance metrics — including Core Web Vitals signals such as LCP, INP, and CLS — are estimated from server response time and page weight using heuristic analysis. They are not produced by a full browser render and may differ from values reported by Google Lighthouse, PageSpeed Insights, or Chrome User Experience Report (CrUX) data.

Free tier scan data may be stored for up to 30 days. Paid plan data is retained according to your plan tier. You are responsible for exporting or saving any data you wish to retain beyond these periods.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that the results obtained from use of the Service will be accurate or reliable.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PILLARCOPIA OPERATING LLC, DBA ZU2B, SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless PillarCopia Operating LLC, DBA ZU2B, and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of a third party.

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by canceling your subscription and contacting us at [email protected].

These Terms shall be governed by and construed in accordance with the internal laws of the State of Texas, without giving effect to any choice or conflict of law provision. Any disputes arising under these Terms shall be resolved in the appropriate courts of competent jurisdiction in Texas.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will otherwise remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PillarCopia Operating LLC regarding the Service and supersede all prior agreements and understandings.
